We offer a wide range of digital solutions including web development, mobile app development, graphic design, digital marketing, outsourcing, and bulk SMS. All services are subject to agreements and scopes defined during the onboarding process.
All content, including designs, code, and strategies developed by SparkMinds Tech remain our intellectual property until full payment is received. Upon payment, ownership is transferred as per agreement.
Clients are responsible for providing timely feedback, required assets, and accurate information for project completion. Delays in communication may result in project timeline shifts.
All projects require an initial deposit. Full payment is due upon project completion unless otherwise agreed. Late payments may incur additional fees and service interruptions.
SparkMinds Tech respects client privacy. All information shared with us will be handled in accordance with our Privacy Policy and will not be shared without consent.
We are not liable for indirect or consequential damages arising from the use of our services. We aim for excellence, but technical disruptions, third-party service failures, or unforeseen circumstances are beyond our control.
Either party may terminate a project agreement with reasonable notice. In the event of termination, clients are obligated to pay for all work completed up to the point of termination.
SparkMinds Tech reserves the right to update these Terms & Conditions at any time. Changes will be posted on our website, and continued use of our services signifies acceptance of any updates.
These Terms & Conditions shall be governed by the laws of Nepal. Any disputes will be resolved under the jurisdiction of the Bharatpur, Chitwan court system.
Any software, application, or code developed by SparkMinds Tech Pvt. Ltd. may be licensed to the client for their use unless explicitly stated otherwise. Redistribution, resale, or duplication of the software without prior written consent is strictly prohibited.
We strive to maintain 99% uptime for all hosted services. In case of any planned maintenance or unforeseen disruptions, clients will be notified in advance when possible. Emergency fixes will be performed as soon as reasonably possible.
All final deliverables including websites, mobile apps, graphics, and marketing materials will become the property of the client once full payment has been received. SparkMinds Tech retains the right to display non-confidential work in its portfolio unless restricted by NDA or contract.
Some services may involve third-party tools, APIs, plugins, or software licenses. SparkMinds Tech is not responsible for issues arising from third-party system failures or policy changes. Clients are responsible for renewal costs of any third-party subscriptions unless otherwise agreed upon.
We offer a limited number of revisions per project phase as specified in the service agreement. Additional revisions or major scope changes will be charged separately based on our standard hourly rates or a revised proposal.
All information exchanged during project discussions will be treated as confidential and will not be disclosed to any third party without prior consent, unless required by law. NDAs can be signed upon request for sensitive projects.
Through our Youth Empowerment Program, SparkMinds Tech may provide internship or learning opportunities on selected client projects (with client permission). This initiative is designed to train future tech professionals under expert supervision without compromising quality.
Due to the nature of digital services, refunds are only issued in cases of non-delivery or mutually agreed project termination. Deposits are non-refundable once the project is initiated, as they cover resource allocation and planning time.
We value client feedback to improve our services. Support is provided via email, phone, or ticket system as outlined in your project agreement. For urgent technical issues, we offer priority support channels based on the agreed SLA.
SparkMinds Tech is not liable for failure to deliver services due to circumstances beyond our control, including but not limited to natural disasters, internet outages, labor strikes, government restrictions, or pandemics.
These Terms & Conditions, along with any signed contracts or proposals, constitute the entire agreement between you and SparkMinds Tech. No other verbal or written agreements shall be binding unless formally amended and signed by both parties.
